The Reexamination Group at WHDA has long experience with reexamination proceedings. We understand the advantages that reexamination has over District Court litigation for accused infringers, including no presumption of patent validity, no requirement of proof of invalidity by clear and convincing evidence, and patent examiners with a high level of technical skill in the Central Reexamination Unit. We also understand that each case must be evaluated on its own merits and in light of the client’s business goals.
