Attack on Jay Walker Patent, among the Reexamination Requests filed Week of July 11, 2011

Walker Digital filed two complaints in April, accusing a who’s-who of video and electronics companies of infringing its U.S. Patent No. 6,263,505 related to data for video programs.  Jay Walker of Priceline fame is on the named inventors on the ‘505 patent.  A so-far unnamed party has now requested reexamination of Walker’s ‘505 patent (see ex parte Request No. (10).

A second reexamination request was filed by Thermo Fisher Scientific against Spectros’ U.S. Patent No. 6,711,426 for white LED medical spectroscopy equipment (see inter partes Request No. (5)).  The ‘426 patent emerged from its first reexamination earlier this year, with some of the claims being canceled and some confirmed.  The two companies are involved in an infringement action regarding the ‘426 patent in the Northern District of California, where  Judge Sandra Brown recently allowed Spectros to add claim 19, one of the confirmed claims, to the case.

The following inter partes requests were filed:

(1)         95/001,682 (electronically filed) – U.S. Patent No. 6,502,135 entitled AGILE NETWORK PROTOCOL FOR SECURE COMMUNICATIONS WITH ASSURED SYSTEM AVAILABILITY and owned by VirnetX.  Filed July 11, 2011.  The ‘135 patent is currently the subject of a litigation styled VirnetX v. Cisco (Case No. 6:10-cv-417 (E.D. Tex.)).

(2)         95/001,683 (electronically filed) – U.S. Patent No. 6,849,360 entitled NONAQUEOUS ELECTROCHEMICAL CELL WITH IMPROVED ENERGY DENSITY and owned by Eveready Battery.  Filed July 11, 2011, by Spectrum Brands. 

(3)         95/001,684 (electronically filed) – U.S. Patent No. Reissue 41,886 entitled NONAQUEOUS ELECTROCHEMICAL CELL WITH IMPROVED ENERGY DENSITY and owned by Eveready Battery.  Filed July 11, 2011, by Spectrum Brands. 

(4)         95/001,687 (electronically filed) – U.S. Patent No. 6,723,345 entitled TOPICAL DRUG PREPARATIONS and owned by GlycoBioSciences.  Filed July 13, 2011, by Nycomed.  The ‘345 patent is currently the subject of a litigation styled GlycoBioSciences v. MPM Medical (Case No. 3:11-cv-01379-EK (N.D. Tex.)); GlycoBioSciences v. Nycomed  (Case No. 11-cv-1539 (D.N.J.)). 

(5)         95/001,688 (electronically filed) – U.S. Patent No. 6,711,426 entitled SPECTROSCOPY ILLUMINATOR WITH IMPROVED DELIVERY EFFICIENCY FOR HIGH OPTICAL DENSITY AND REDUCED THERMAL LOAD and owned by Spectros.  Filed July 13, 2011, likely by Thermo Fisher Scientific.  The ‘426 patent is currently the subject of a litigation styled Spectros v. Thermo Fisher Scientific (Case No. 09-cv-1996-SBA (N.D. Cal.)).
