Volkswagen Challenges Cruise Control Tech. Patent, Week of April 15, 2013

Volkswagen has requested ex parte reexamination of U.S. Patent No. 6,324,463 that is owned by Cruise Control Technologies and claims cruise control indicators (see ex parte Request No. (3)).  Cruise Control has sued VW, as well as BMW and Audi, for infringement of the ‘463 patent.

Ariosa Diagnostics requested a second inter partes review of Isis’ U.S. Patent No. 6,258,540 (see inter partes review Request No. (2)).  The ‘540 patent claims methods that “enable[] non-invasive prenatal diagnosis including for example sex determination, blood typing and other genotyping, and detection of pre-eclampsia in the mother.”  This request seeks review of claims that are not the subject of the earlier inter partes review.

The following inter partes review requests were filed:

(1)         IPR2013-00249 (electronically filed) – U.S. Patent No. 6,981,007 entitled ONSITE BACKUP FOR INTERNET-BASED DATA PROCESSING and owned by Whitserve, LLC, and licensed to Computer Patent Annuities, LP. Filed April 15, 2013 by Google.

(2)         IPR2013-00250 (electronically filed) – U.S. Patent No. 6,258,540 entitled NON-INVASIVE PRENATAL DIAGNOSIS and owned by Isis. Filed April 19, 2013 by Ariosa Diagnostics.  The ‘540 patent is the subject of an infringement action entitled Ariosa Diagnostics v. Sequenom et al. (Case No. 3:11-cv-6391 (N.D. Cal.)).

(3)         IPR2013-00252 (electronically filed) – U.S. Patent No. 5,495,291 entitled DECOMPRESSION SYSTEM FOR COMPRESSED VIDEO DATA FOR PROVIDING UNINTERRUPTED DECOMPRESSED VIDEO DATA OUTPUT and owned by Avid. Filed April 19, 2013 by Harmonic.  The ‘291 patent is the subject of an infringement action entitled Avid v. Harmonic. (Case No. 1:12-cv-627 (D. Del.)).

The following ex parte requests were filed:

(1)         90/012,839 (electronically filed) – U.S. Patent No. RE44,144 entitled EXPANDABLE BROADHEAD and owned by Field Logic Inc. Filed April 15, 2013. RE44,144 is currently the subject matter of a litigation styled Out Rage LLC v. New Archery Products Corporation (Case No. 3:13-CV-240 (W.D. Wis.)).

(2)         90/012,840 (electronically filed) – U.S. Patent No. 6,848,322 entitled APPARATUS AND METHOD FOR TESTING WELD INTEGRITY and owned by Randall Scarborough. Filed April 15, 2013 by IntegriCert, LLC. The ‘322 patent is currently the subject matter of a litigation styled Randall Scarborough v. IntegriCert, LLC (Case No. 6:12-CV-00396 (W.D. La.)).

(3)         90/012,841 (electronically filed) – U.S. Patent No. 6,324,463 entitled CRUISE CONTROL INDICATOR and owned by Cruise Control Technologies, LLC. Filed April 15, 2013 by Volkswagen. The ‘463 patent is currently the subject matter of a litigation styled Cruise Control Technologies, LLC v. Volkswagen Group of America, Inc. (Case No. 1:13-cv-00087-GMS (D. Del.)); Cruise Control Technologies, LLC v. Audi of America, LLC (Case No. 1:12-cv-01753-GMS (D. Del.)); Cruise Control Technologies, LLC v. BMW of North America, LLC (Case No. 1:12-cv-01754-GMS (D. Del.)); the Patent Owner also asserted the ‘463 patent against a host of other prominent auto manufacturers, including Chrysler, General Motors, Porsche, and Honda.

(4)         90/012,842 (electronically filed) – U.S. Patent No. 7,284,447 entitled APPARATUS AND METHOD FOR TESTING WELD INTEGRITY and owned by Randall Scarborough.
