Sprint Challenges Two Comcast Patents, Week of April 22, 2013

Last Wednesday Sprint requested ex parte reexamination of two Comcast patents that claim methods for accessing telecommunications data (see ex parte Request Nos. (3) & (4)).  Comcast has sued Sprint in Delaware for infringement of the patents.  Sprint’s choice of ex parte reexamination over inter partes review is noteworthy.

Also on Wednesday, InvenSense requested inter partes review of a tungsten-contact semiconductor patent owned by STMicroelectronics (see inter partes review Request No. (2)).   The latter recently sued InvenSense for infringement of the patent, both in California and at the U.S. International Trade Commission.

The following inter partes review requests were filed:

(1)         IPR2013-00253 (electronically filed) – U.S. Patent No. 8,083,997 entitled CONVERSION OF NITROGEN DIOXIDE (NO2) TO NITRIC OXIDE (NO) and owned by GeNO LLC. Filed April 24, 2013 by Ikaria, Inc.

(2)         IPR2013-00254 (electronically filed) – U.S. Patent No. 6,034,419 entitled SEMICONDUCTOR DEVICE WITH A TUNGSTEN CONTACT and owned by STMicroelectronics, Inc. Filed April 24, 2013 by InvenSense, Inc. The ‘419 patent is currently the subject matter of a litigation styled STMicroelectronics, Inc. v. InvenSense, Inc. (Case No. 13-cv-1116 (N.D. Cal.)); In re Certain Microelectromechanical Systems (“MEMS Devices”) and Products Containing Same (Inv. No. 337-TA-876 (USITC)).

(3)         IPR2013-00255 (electronically filed) – U.S. Patent No. 6,970,183 entitled MULTIMEDIA SURVEILLANCE SYSTEM INCLUDING NETWORK CONFIGURATION and owned by e-Watch. Filed April 26, 2013 by Mobotix.  The ‘183 patent is the subject of an infringement action styled e-Watch, Inc. v. Mobotix Corp., (Case No. 5:12-cv-00492 (W. D. Tex.)).

The following ex parte requests were filed:

(1)         90/012,843 (electronically filed) – U.S. Patent No. 8,095,064 entitled SATELLITE BROADCAST RECEIVING AND DISTRIBUTION SYSTEM and owned by Global Communications, Inc. Filed April 19, 2013. The ‘064 patent is currently the subject matter of a litigation styled Global Communications, Inc. v. DirecTV, Inc., et al. (Case No. 4:12-cv-00651-RH-CAS (N.D. Fla.)); Global Communications, Inc. v. PDI Communications, Inc., et al. (Case No. 4:11-cv-00541 (N.D. Fla.)).

(2)         90/012,844 (electronically filed) – U.S. Patent No. 6,128,415 entitled DEVICE PROFILES FOR USE IN A DIGITAL IMAGE PROCESSING SYSTEM and owned by Digitech Image Technologies.  Filed April 19, 2013 by Sony Electronics.  The ‘415 patent is the subject of an infringement action styled Digitech Image Technologies v. Sony (Case No. 12-cv-1678 (C.D. Cal.)).

(3)         90/012,845 (electronically filed) – U.S. Patent No. 7,012,916 entitled. METHOD AND APPARATUS FOR ACCESSING COMMUNICATION DATA RELEVANT TO A TARGET ENTITY IDENTIFIED BY A NUMBER STRING and owned by Comcast IP Holdings.  Filed April 24, 2013 by Sprint.  The ‘916 patent is the subject of an infringement action styled Comcast IP Holdings v. Sprint (Case No. 12-cv-205 (D. Del.)).

(4)         90/012,846 (electronically filed) – U.S. Patent No. 8,204,046 entitled METHOD AND APPARATUS FOR ACCESSING SERVICE RESOURCE ITEMS THAT ARE FOR USE IN A TELECOMMUNICATIONS SYSTEM. And owned by Comcast IP Holdings.  Filed April 24, 2013 by Sprint.  The ‘046 patent is the subject of an infringement action styled Comcast IP Holdings v. Sprint (Case No. 12-cv-205 (D. Del.)).

(5)         90/012,847 (electronically filed) – U.S. Patent No.7,661,764  entitled VEHICLE SEAT ASSEMBLY HAVING A HARDNESS GRADIENT VIA “A” SURFACE INTRUSIONS AND/ OR PROTRUSIONS and owned by Lear Corporation.  Filed April 26, 2013.
