Zynga Patents Target of IPR Requests, Week of February 25, 2013

Last week Personalized Media Communications requested inter partes review of three mass media programming patents owned by Zynga (see inter partes review Request Nos. (2), (3) & (8)).  Zynga’s patents claim unified systems for programming mass communication, including uses for television, radio, broadcast hardcopy, and computer communications.  The two companies are involved in an infringement action regarding the patents, in the Eastern Disrtict if Texas.

General Electric saw attacks by Vibrant Media, Inc. on two of its hypertext patents (see inter partes review Request Nos. (6) & (9)).  GE has sued Vibrant and others for infringement of the patents.

The following inter partes review requests were filed:

(1)         IPR2013-00159 (electronically filed) – U.S. Patent No. 8,273,183 entitled AUTOMATED SWIMMING POOL CLEANER HAVING AN ANGLED JET DRIVE PROPULSION SYSTEM and owned by Aqua Products, Inc. Filed February 25, 2013 by Zodiac Pool Systems, Inc. The ‘183 patent is currently the subject matter of a litigation styled Aqua Products, Inc. v. Zodiac Pool Systems, Inc. (Case no. 12-cv-9342 (S.D.N.Y.)).

(2)         IPR2013-00162 (electronically filed) – U.S. Patent No. 7,908,638 entitled SIGNAL PROCESSING APPARATUS AND METHODS and owned by Personalized Media Communications, LLC.  Filed February 26, 2013 by Zynga, Inc.  The ‘638 patent is currently the subject matter of a litigation styled Personalized Media Communications, LLC v. Zynga, Inc. (Case No. 2:12-cv-68-JRG (E.D. Tex.)).

(3)         IPR2013-00164 (electronically filed) – U.S. Patent No. 7,797,717 entitled SIGNAL PROCESSING APPARATUS AND METHODS and owned by Personalized Media Communications, LLC.  Filed February 26, 2013 by Zynga, Inc. The ‘717 patent is currently the subject matter of a litigation styled Personalized Media Communications, LLC v. Zynga, Inc. (Case No. 2:12-cv-68-JRG (E.D. Tex.)).

(4)         IPR2013-00167 (electronically filed) – U.S. Patent No. 5,620,723 entitled INJECTION MOLDING MACHINE and owned by Husky Injection Molding Systems, Ltd. Filed February 27, 2013 by Athena Automation, Ltd.

(5)         IPR2013-00168 (electronically filed) – U.S. Patent No. 5,414,426 entitled FAVORITE KEY MACRO COMMAND AND CHAINED MACRO COMMAND IN A REMOTE CONTROL and owned by Universal Electronics, Inc. Filed February 26, 2013 by Universal Remote Control, Inc. The ’426 patent is currently the subject matter of a litigation styled Universal Electronics, Inc. v. Universal Remote Control, Inc. (Case No. SACV-12-00329-AG (C.D. Cal.)). Three other patents were asserted in the litigation, including U.S. Patent No. 6,587,067 (IPR2013-00127) and 5,614,906 (IPR2013-00152).
