Reexamination of Apple Speech Recognition Patent Sought, Week of January 7, 2013

This past October Dynamic Advances sued Apple, alleging that the Siri personal assistant in iPads and iPods infringes U.S. Patent No. 7,177,798.  The ‘798 patent claims a method for processing a natural language input provided by a user.  Dynamic Advances, which identifies a suite in Tyler Texas as its principal place of business, obtained the ‘798 patent from Rensselaer Polytechnic Institute.  In its Complaint, Dynamic Advances points out that the ‘798 patent was cited during Apple’s prosecution of a patent application that ultimately issued as U.S. Patent No. 8,289,283.  Dynamic Advances appears to be relying upon the drawings of the ‘283 patent to illustrate Apple’s infringement of the ‘798 patent.

Dynamic Advances has now taken the additional step of seeking ex parte reexamination of Apple’s ‘283 patent (see ex parte Request No. (4)). The strategy behind the reexamination request might be to press Apple to make admissions regarding claim construction, the scope of the ‘798 claims, or the meaning of the prior art.

Analog Devices has requested inter partes review of U.S.  Patent No. 7,439,616, a microphone patent owned by Knowles Electronics (see inter partes review Request No. (2)). Knowles has sued Analog in the ITC for infringement of the ‘616 patent.  It will be interesting to see how Analog uses the IPR proceeding to influence the ITC investigation.

Redline Detection, LLC et al. (Case No. SACV12-1861-DOC (C.D. Cal.)).

(2)         IPR2013-00107 (electronically filed) – U.S. Patent No. 8,103,313 entitled PORTABLE COMMUNICATOR and owned by ADC Technology.  Filed January 11, 2013 by Kyocera.

(3)         IPR2013-00108 (electronically filed) – U.S. Patent No. 7,439,616 entitled MINIATURE SILICON CONDENSER MICROPHONE and owned by Knowles Electronics, LLC.  Filed January 10, 2013 by Analog Devices, Inc.  The ‘616 patent is currently the subject of a litigation styled Certain Silicon Microphone Packages and Products Containing Same(Inv. No. 337-TA-825 (USITC)).  Knowles Electronics filed the ITC complaint against Analog Devices, Inc., Amkor Technology, Inc., and Avnet, Inc.

(4)         IPR2013-00109 (electronically filed) – U.S. Patent No. 6,757,717 entitled SYSTEM AND METHOD FOR DATA ACCESS and owned by Proxyconn.  Filed January 11, 2013 by Microsoft.  The ‘717 patent is the subject of a litigation styled Proxyconn v. Microsoft (Case No. 8:11-cv-1681 (C.D. Cal.)).

(5)         IPR2013-00110 (electronically filed) – U.S. Patent No. 6,209,259 entitled SEEDING TREATMENTS and owned by Encap, LLC.  Filed January 11, 2013 by The Scotts Company LLC.  The ‘259 patent is currently the subject of a litigation styled Encap, LLC v. The Scotts Company, LLC, et al. (Case No. 1:11-cv-000685-WCG (E.D. Wis.)).

(6)         IPR2013-00111 (electronically filed) – U.S. Patent No. 6,494,387 entitled LOW-PRESSURE ATOMIZING SPRAY GUN and owned by Anest Iwata.  Filed January 11, 2013 by Sata GmbH & Co. KG.
