Nike Shoe Patent Target of Inter Partes Review Request, Week of November 26, 2012

Rival adidas requested inter partes review of a Nike shoe patent (see inter partes review Request No. (3)).  There does not yet appear to be any litigation between the companies over this patent.

Chimei Innolux continues to challenge Semiconductor Energy Lab patents, last week requesting inter partes review of three Innolux thin film patents (see inter partes review Request Nos. (1), (2) & (4).  There were so many bases for attacking SEL’s ‘311 patent, that Chimei split them into two Requests.

The following inter partes review requests were filed:

(1)         IPR2013-00064 & IPR2013-00065 (electronically filed) – U.S. Patent No. 7,923,311 entitled Electro-Optical Device and Thin Film Transistor and Method for Forming the Same and owned by Semiconductor Energy Laboratory Co., Ltd.  Filed November 26, 2012 by Chimei Innolux Corp.  The ‘311 patent is currently the subject of a litigation styled Semiconductor Energy Laboratory Co., Ltd. v. Chi Mei Innolux Corp., et al.  (Case No. SACV12-0021-JST (C.D. Cal.)).

(2)         IPR2013-00066 (electronically filed) – U.S. Patent No. 7,876,413 entitled electronic apparatus with a flexible printed circuit and a transparent conductive layer and owned by Semiconductor Energy Laboratory Co., Ltd.  Filed November 28, 2012 by Chimei Innolux Corp.  The ‘413 patent is currently the subject of a litigation styled Semiconductor Energy Laboratory Co., Ltd. v. Chi Mei Innolux Corp., et al.  (Case No. SACV12-0021-JST (C.D. Cal.)).

(3)         IPR2013-00067 (electronically filed) – U.S. Patent No. 7,347,011 entitled ARTICLE OF FOOTWEAR HAVING A TEXTILE UPPER and owned by Nike.  Filed November 29, 2012 by adidas.

(4)         IPR2013-00068 (electronically filed) – U.S. Patent No. 8,068,204 entitled electronic apparatus with a flexible printed circuit and a transparent conductive layer and owned by Semiconductor Energy Laboratory Co., Ltd.  Filed November 30, 2012 by Chimei Innolux Corp.  The ‘204 patent is currently the subject of a litigation styled Semiconductor Energy Laboratory Co., Ltd. v. Chi Mei Innolux Corp., et al.  (Case No. SACV12-0021-JST (C.D. Cal.)).

The following ex parte requests were filed:

(1)         90/012,725 (electronically filed) – U.S. Patent No. 5,529,153 entitled Tilt Control Apparatus for Vehicles and owned by Cloud Farm Associates L.P.  Filed November 26, 2012 by Volkswagen Group of America.  The ‘153 patent is currently the subject of a litigation styled Cloud Farm Associates, L.P. v. (2)         90/012,726 (electronically filed) – U.S. Patent No. 6,012,890 entitled Electronic Bookstore Vending Machine and owned by Victor Manuel Celorio.  Filed November 27, 2012 by On Demand Books, LLC.  The ‘890 patent is currently the subject of a litigation styled Victor Manuel Celorio vs. Google, Inc., et al. (Case No. 1:11-cv-00079-SPM-GRJ (N.D. Fla.)).
