Microsoft Challenge to NetView Patent, among the Reexamination Requests filed Week of November 7, 2011

Inter partes reexamination continues to be the weapon of choice for major Internet/software companies.  Last week Microsoft requested reexamination of U.S. Patent No. 7,251,776 owned by NetView (see inter partes Request No. (1)).  NetView is pursuing an action against Microsoft in Massachusetts, asserting infringement of the ‘776 patent. 

Inter partes reexamination was also requested against U.S. Patent No. 7,426,264 which claims methods for mobile messaging and which is owned by Intellect Wireless (see inter partes Request No. (6)).   It is not yet clear who filed the Request, but Intellect Wireless has previously sued Apple, Heio, HTC, LG, Samsung, Sanyo, T-Mobile, and Virgin Mobile for infringement of related patents. 

After requesting reexamination of six Brocade server patents the previous week, A10 Networks filed three more requests last week. (see inter partes Request Nos. (3), (4) & (7)).

 The following inter partes requests were filed:

(1)         95/001,809 (electronically filed) – U.S. Patent No. 7,251,776 entitled SYSTEM AND METHOD FOR EFFICIENTLY AND FLEXIBLY UTILIZING SPREADSHEET INFORMATION and owned by NetView Technologies.  Filed November 7, 2011 by Microsoft.  The ‘776 patent is currently the subject of a litigation styled NetView Technologies v. Microsoft (Case No.. 1:09–cv-12072 (D. Mass.)).

(2)         95/001,810 (electronically filed) – U.S. Patent No. 7,766,711 entitled HARDWARE-LESS WAKEBOARD BINDING COMPONENT AND ASSEMBLY AND METHOD OF MAKING ASSEMBLY and owned by Motion Water Sports.  Filed November 8, 2011, by Square One Distribution.  The ‘711 patent is currently the subject of a litigation styled Motion Water Sports v. Square one Distribution (Case No. 11cv-1375-LAB (S.D. Cal.)). 

(3)         95/001,811 (electronically filed) – U.S. Patent No. 7,774,833 entitled SYSTEM AND METHOD FOR PROTECTING CPU AGAINST REMOTE ACCESS ATTACKS and owned by Brocade.  Filed November 8, 2011, by A10 Networks.  The ‘833 patent is currently the subject of a litigation styled Brocade Comm. Sys. et al. v. A10 Networks (Case No. 5:10-cv-3428 (N.D. Cal.)).

(4)         95/001,812 (electronically filed) – U.S. Patent No. 7,584,301 entitled HOST-LEVEL POLICIES FOR GLOBAL SERVER LOAD BALANCING and owned by Brocade.  Filed November 8, 2011, by A10 Networks.  The ‘301 patent is currently the subject of a litigation styled Brocade Comm. Sys. et al. v. A10 Networks (Case No. 5:10-cv-3428 (N.D. Cal.)).
