Challenge to Intel Data Evaluation Patent, among Reexamination Requests Filed Week of October 3, 2011

Intel obtained a patent last year for a method for sifting through data on “a support vector machine” to obtain certain information.  The method appears to have diverse applications, including the identification of disease-causing genes.  A request for reexamination of Intel’s patent was filed last Monday (see ex parte Request No. (1)). Though PTO documents do not disclose the identity of the Requester, it might be Health Discovery Corporation which is now attempting to provoke an interference with the Intel patent.

IBM requested reexamination of an Acqis computer security patent (see inter partes Request No. (3)). Acqis won a judgment against IBM earlier this year for $12 million in damages and $18.5 million in costs after a jury verdict of infringement of three other patents.  On Thursday IBM filed a declaratory judgment action against Acqis regarding the ‘814 patent.

The following inter partes requests were filed:

(1)         95/001,774 (electronically filed) – U.S. Patent No. 8,030,348 entitled NATURAL MARINE SOURCE PHOSPHOLIPIDS COMPRISING POLYUNSATURATED FATTY ACIDS AND THEIR APPLICATIONS and owned by Neptune.  Filed October 4, 2011, by Aker BioMarine ASA.  The ‘348 patent is currently the subject of a litigation styled Neptune Technologies & Bioresources v. (2)         95/001,775 (electronically filed) – U.S. Patent No. 7,779,581 entitled REPLACEABLE WET-SET TACTILE WARNING SURFACE UNIT AND METHOD OF INSTALLATION AND REPLACEMENT and owned by ADA Solutions.  Filed October 4, 2011.  The ‘581 patent is currently the subject of a litigation styled ADA Solutions, Inc. v. Engineered Plastics, Inc. d/b/a Armor-Title, et al. (Case No. 1:10-cv-11512 (D. Mass.)).

(3)         95/001,776 (electronically filed) – U.S. Patent No. RE 42,814 entitled PASSWORD PROTECTED MODULAR COMPUTER METHOD AND DEVICE and owned by Acqis Technology.  Filed October 4, 2011, by IBM.  The ‘814 patent is currently the subject of a declaratory judgment action styled IBM v. Acqis (Case No. 11-cv-4896 (N.D. Cal.)).

(4)         95/001,777 (electronically filed) – U.S. Patent No. 7,305,076 entitled METHOD AND APPARATUS FOR IMPROVED PAGING RECEIVER AND SYSTEM and owned by Intellect Wireless.  Filed October 6, 2011.
