Verizon Attack on EMSAT Cell Phone System Patent among Reexamination Requests Filed Week of December 13, 2010

The most interesting reexamination request last week was filed by Verizon Wireless against EMSAT’s U.S. Patent No. 7,289,763 for a cellular telephone system (see Inter partes Request No. (6)).  EMSAT had sued nine companies for infringement of the ‘763 patent, including Verizon. 

But perhaps most noteworthy was the fact that Apple did not file any requests.

The following inter partes requests were filed:

(2)         95/001,508 (electronically filed) – U.S. Patent No. 7,702,809 entitled METHOD AND SYSTEM FOR SCALING NETWORK TRAFFIC MANAGERS and owned by F5 Networks, Inc. Filed December 13, 2010, by A10 Networks, Inc.  The ‘809 patent is currently the subject of a litigation styled F5 Networks, Inc. v. A10 Networks, Inc., (Case No. 2:10-cv-654-MJP (W.D. Wash.)). 

(3)         95/001,509 (electronically filed) – U.S. Patent No. 7.697,427 entitled METHOD AND SYSTEM FOR SCALING NETWORK TRAFFIC MANAGERS and owned by F5 Networks, Inc.  Filed December 13, 2010, by A10 Networks, Inc.  The ‘427 patent is currently the subject of a litigation styled F5 Networks, Inc. v. A10 Networks, Inc., (Case No. 2:10-cv-654-MJP (W.D. Wash.)). 

(4)         95/001,510 (electronically filed) – U.S. Patent No. 7,395,349 entitled METHOD AND SYSTEM FOR SCALING NETWORK TRAFFIC MANAGERS and owned by F5 Networks, Inc.  Filed December 13, 2010, by A10 Networks, Inc.  The ‘349 patent is currently the subject of a litigation styled F5 Networks, Inc. v. (6)         95/001,512 (electronically filed) – U.S. Patent No. 7,289,763 entitled CELLULAR TELEPHONE SYSTEM THAT USES POSITION OF A MOBILE UNIT TO MAKE CALL MANAGEMENT DECISIONS and owned by EMSAT Advanced Geo-Location Tech., LLC.  Filed December 14, 2010, by Verizon Wireless.  The ‘763 patent is currently the subject of a litigation styled EMSAT Advanced Geo-Location Tech. v. Cellco Partnership, (Case No, 4:08-cv-00816-SL (N.D. Ohio)), as well as eight other cases.
